Regulatory Context

New Jersey's FWPA creates one of the most protective state wetland frameworks in the US, regulating all freshwater wetlands and their transition areas (buffers of 50–150 feet depending on resource value). NJDEP issues its own Individual Permits and Letters of Interpretation (LOIs) - including Presence/Absence, Line Verification, and Extent of Regulated Activity determinations - that must be coordinated with federal 404 permits.
