Regulatory Context

New York regulates freshwater wetlands ≥12.4 acres (5 hectares) and their 100-foot adjacent areas under Article 24, independently of federal jurisdiction. NYSDEC maintains its own mapped wetland inventory (NWI) which serves as a starting point but does not replace field delineation. Tidal wetlands receive separate regulation under Article 25 with distinct boundary mapping protocols.
